CANCELLATION, ANNULMENT, AND REFUND POLICY<\/h6>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

\n\t\t\t\t\t\t\t\t\t

Once payment for a booking has been received, FOX AVENTURS<\/b> (hereinafter \u00abTHE AGENCY\u00bb) may proceed with purchasing, issuing, and\/or confirming the contracted services, including those subject to specific conditions, restrictions, and policies established by THIRD-PARTY SUPPLIERS<\/b> or competent public authorities.<\/p>

Regarding Machu Picchu entrance tickets<\/b>, their issuance, modification, rescheduling, cancellation, and, where applicable, refund, are subject to the rules and conditions set forth by the competent government authority in effect at the time of purchase. Consequently, when a service has been purchased under express non-refundable terms, no amount shall be eligible for a refund unless the supplier, the competent authority, or applicable law explicitly dictates otherwise.<\/p>

Modification requests submitted by THE CLIENT<\/b> thirty (30) calendar days or fewer prior to the scheduled service start date may be subject to penalties, restrictions, or fee charges of up to one hundred percent (100%) of the total booking cost. This depends on the nature of the service, specific booking conditions, real-time availability, and the governing policies of the relevant supplier or authority. The application of such conditions will be communicated to THE CLIENT whenever applicable.<\/p>

Furthermore, a failure by THE PASSENGER<\/b> to appear at the designated location, date, and time for service delivery shall be classified as a NO-SHOW<\/b>. A No-Show may result in the partial or total forfeiture of the amount paid, provided this consequence was disclosed in advance, set forth in the applicable service terms, and deemed appropriate under the relevant supplier policies and current regulations.<\/p>

1. Flexible Services<\/strong><\/p>

Cancellation and refund terms for tourism services offered by THE AGENCY are determined based on the nature, characteristics, availability, and booking conditions of each tour or service reserved. Consequently, timelines, penalty percentages, and refundable amounts may vary depending on the contracted service, non-recoverable costs incurred by THE AGENCY, and third-party supplier terms.<\/p>

As a general rule, cancellations requested 30 calendar days or more in advance<\/b> may qualify for a refund of up to 90%<\/b> of the amount paid, with 10% retained as administrative fees<\/b>. Cancellations requested:<\/p>

  • Between 15 and 29 days in advance<\/b> may incur a penalty of up to 30%<\/b>.<\/p><\/li>

  • Between 7 and 14 days in advance<\/b> may incur a penalty of up to 50%<\/b>.<\/p><\/li>

  • Fewer than 7 days in advance<\/b> may be deemed entirely non-refundable<\/b>.<\/p><\/li><\/ul>

    However, whenever specific services, admissions, tickets, permits, transfers, accommodations, or other components have been secured or confirmed in advance by THE AGENCY under non-refundable terms, those specific conditions shall supersede. In such cases, any refund shall be strictly contingent upon amounts actually recovered from suppliers.<\/p>

    Specific cancellation policies for each tour or booking will be disclosed to THE CLIENT prior to purchase confirmation. Once accepted, these terms form an integral part of the service contract and take precedence over general terms where specifically applicable.<\/p>

    2. Non-Refundable Services<\/strong><\/p>

    Certain tourism services, due to their nature, strict capacity caps, or procurement terms, are subject to modification, cancellation, or refund restrictions imposed by the governing supplier, operator, or authority. These include, where applicable:<\/p>

    • Machu Picchu and Inca Trail entrance permits<\/p><\/li>

    • Train service tickets<\/p><\/li>

    • Airline tickets<\/p><\/li>

    • Specific attraction admission passes<\/p><\/li><\/ul>

      Once these services have been purchased or issued, any modification, cancellation, or refund is strictly governed by the issuing entity or supplier’s policies. THE AGENCY will inform THE CLIENT prior to booking confirmation of any specific restrictions that apply, particularly regarding non-refundable services. In these cases, THE AGENCY cannot guarantee the refund of any amounts that the third-party supplier or authority refuses to release, without prejudice to any statutory rights guaranteed to THE CLIENT under applicable law.<\/p>

      3. No-Show Policy<\/strong><\/p>

      If THE PASSENGER fails to show up at the scheduled place, date, and time for the start of the service, it will be declared a NO-SHOW<\/b>. In such events, the pre-established cancellation terms and penalties for the contracted service shall apply, which may entail total forfeiture of the amount paid.<\/p>

      If passenger delays or non-attendance lead to missed train connections, flights, entrance tickets, or other reserved services, any additional costs arising from the situation shall be borne solely by THE CLIENT, provided the delay is attributable to the client and not caused by negligence on the part of THE AGENCY or its service provider.<\/p>

      4.-<\/strong> MODIFICATIONS, UNFORESEEN EVENTS, AND FORCE MAJEURE<\/strong><\/p>

      THE AGENCY reserves the right to make reasonable alterations to itineraries, schedules, modes of transportation, accommodations, or other service aspects whenever necessary for safety, availability, operational conditions, government directives, or unforeseen events. THE AGENCY will endeavor to preserve the overall quality, scope, and intent of the original service package.<\/p>

      When service delivery is disrupted by Force Majeure or fortuitous events<\/b>\u2014including natural disasters, extreme weather conditions, strikes, blockades, civil unrest, access restrictions, government orders, or other unforeseeable and unavoidable events beyond the reasonable control of the parties\u2014THE AGENCY will notify THE CLIENT as soon as practicable and attempt to reschedule the service or offer a reasonably equivalent alternative, subject to availability.<\/p>

      If rescheduling or providing an alternative is impossible, any applicable refund will be calculated strictly based on services actually unperformed and the refund policies of the involved THIRD-PARTY SUPPLIERS<\/b>. THE AGENCY shall not assume personal or out-of-pocket expenses incurred by THE PASSENGER that fall outside the contracted service scope, unless resulting from a breach legally attributable to THE AGENCY.<\/p>

      The foregoing provisions apply in accordance with Law No. 32392 (New General Tourism Law), its Regulations approved by Supreme Decree No. 002-2026-MINCETUR, and the Consumer Protection and Defense Code, respecting mandatory rights granted to consumers at all times.<\/p>

      5. PASSENGER RESPONSIBILITIES AND OBLIGATIONS<\/strong><\/p>

      THE PASSENGER must provide truthful, accurate, and relevant information required for the proper execution of the service and promptly communicate any circumstance that may affect their participation in booked activities. Furthermore, THE PASSENGER is solely responsible for possessing valid identity cards, passports, visas, permits, or health entries required for travel.<\/p>

      For activities conducted at high altitudes<\/b> (such as Cusco, Vinicunca \/ Rainbow Mountain, or Humantay Lake), THE PASSENGER must exercise due care and disclose any medical condition relevant to their participation. Practical travel guidance provided by THE AGENCY does not substitute for professional medical advice or evaluation.<\/p>

      THE PASSENGER agrees to observe all safety, etiquette, and environmental conservation rules at visited sites and follow reasonable instructions issued by guides and tour staff. Any property damage caused by intentional misconduct or negligence on the part of the passenger shall be paid for by the passenger in accordance with applicable law.<\/p>

      Regarding luggage, cash, travel documents, and personal belongings, THE PASSENGER is responsible for maintaining custody over their items at all times. THE AGENCY assumes no liability for loss, theft, or damage unless items were formally handed over under its direct custody.<\/p>

      6.- INTELLECTUAL PROPERTY<\/strong><\/p>

      All content distributed across FOX AVENTURS’ website, social media, and digital media\u2014including text, photos, videos, logos, graphics, brand design, and custom itineraries\u2014is protected under Peruvian copyright and intellectual property legislation.<\/p>

      Any unauthorized reproduction, distribution, modification, or commercial exploitation without prior express written consent from FOX AVENTURS or the respective rights holder is strictly prohibited, except for uses explicitly permitted under applicable copyright laws.<\/p>

      7.-GOVERNING LAW AND DISPUTE RESOLUTION<\/strong><\/p>

      These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the Republic of Peru, specifically the applicable provisions of Law No. 29571 (Consumer Protection and Defense Code), Law No. 32392 (New General Tourism Law), its Regulations approved by Supreme Decree No. 002-2026-MINCETUR, and related tourism legislation.<\/p>

      Any dispute, disagreement, or claim arising from the contracting, interpretation, execution, or delivery of services shall first be addressed through THE AGENCY’s customer service and claims channels, with both parties agreeing to seek a direct, reasonable, and good-faith resolution.<\/p>

      Notwithstanding the above, THE CLIENT retains the right to utilize consumer protection and dispute resolution mechanisms guaranteed under Peruvian law\u2014including the Official Complaints Book (Libro de Reclamaciones<\/i>), formal conciliation, administrative proceedings before INDECOPI, or other statutory avenues.<\/p>

      If a resolution cannot be reached through the aforementioned mechanisms, either party may submit the dispute to judicial courts, arbitration, or statutory dispute channels under applicable procedural rules. Under no circumstances shall these Terms and Conditions be interpreted as a waiver, limitation, or restriction of the non-waivable statutory rights granted to consumers under Peruvian law.<\/p>
