The purpose of these General Terms and Conditions for Tourism Services is to establish and regulate the rights, obligations, and terms applicable to the contractual relationship between FOX AVENTURS, identified with RUC No. 20612671371, with registered address at Pasaje San Francisco No. 10, District, Province, and Department of Cusco, Peru (hereinafter, “THE AGENCY”), and any natural or legal person requesting, contracting, booking, or purchasing any of the tourism services offered by the former (hereinafter, “THE CLIENT” and/or “THE PASSENGER”, as applicable).
Contracting any of the services offered by THE AGENCY, accepting a quote or commercial proposal, confirming a booking, making a payment, or expressing explicit intent through any of the communication and sales channels enabled by THE AGENCY—including its website, email, digital forms, social media platforms, and WhatsApp (+51 959 786 320)—shall constitute full acceptance of these Terms and Conditions to the extent applicable to the specific service booked.
THE CLIENT declares that, prior to contracting, they have had effective access to read, review, and understand these Terms and Conditions as well as the specific terms applicable to the requested service. Consequently, booking confirmation, quote acceptance, or service contracting shall signify explicit consent to the applicable terms of service.
Acceptance of these Terms and Conditions is executed without prejudice to any rights guaranteed to THE CLIENT under the Political Constitution of Peru, the Consumer Protection and Defense Code, sectoral tourism regulations, and all other mandatory applicable laws.
If THE CLIENT does not agree with any of the terms or conditions applicable to the service they intend to contract, they must refrain from confirming the booking or completing the purchase. Under no circumstances shall the provisions of these Terms and Conditions be construed as a waiver, limitation, or restriction of statutory rights granted by mandatory consumer protection laws.
2. DEFINITIONS
For the purposes of interpreting, applying, and executing these Terms and Conditions, the following terms shall have the meanings assigned below, unless the context explicitly indicates otherwise:
THE AGENCY: FOX AVENTURS, a natural or legal person engaged in marketing, organizing, coordinating, and/or acting as an intermediary for tourism services within Peruvian territory, according to the specific nature of each contracted service.
THE CLIENT: The natural or legal person who, on their own behalf or representing third parties, requests, quotes, contracts, books, or makes partial or total payment for one or more tourism services offered or managed by «FOX AVENTURS».
THE PASSENGER: The natural person who actually travels, participates in the tourism activity, or uses the contracted service, who may or may not be the same person who made the reservation, contract, or payment.
NO-SHOW: A situation occurring when THE PASSENGER fails to appear at the designated place, date, and time for the delivery of the contracted service without prior notice of cancellation, rescheduling, or modification within the prescribed timeframe and terms for said service.
FORCE MAJEURE OR FORTUITOUS EVENT: An extraordinary, unforeseeable, or unavoidable event beyond the reasonable control and scope of the parties that prevents, restricts, or disrupts, in whole or in part, the ordinary execution of obligations linked to the contracted service. This includes, depending on specific circumstances, natural events, extraordinary weather conditions, natural disasters, strikes, work stoppages, road blockades, civil unrest, health emergencies, official authority mandates, or similar events meeting the legal threshold to be classified as such.
THIRD-PARTY SUPPLIERS: Independent natural or legal entities separate from THE AGENCY that participate, directly or indirectly, in executing or providing the booked tourism services, such as hotels, ground/air/rail transport companies, tour operators, restaurants, tour guides, excursion providers, concessionaires, and other related vendors.
3.- BOOKING AND CONTRACTING PROCESS
3.1. Inquiries and Quotations
All information, service descriptions, itineraries, rates, visual media, promotions, and other materials published by THE AGENCY across its website, social channels, digital catalogs, promotional material, or electronic platforms are strictly informational and reference-only, subject to real-time availability, validity periods, modifications, and specific service conditions.
The contracting process begins when THE CLIENT submits an inquiry for information, availability, or a price quote regarding specific tourism services. Upon receiving such a request, THE AGENCY may issue a commercial proposal or quotation detailing, where applicable, the service description, itinerary, dates/duration, inclusions and exclusions, price, currency, offer validity period, payment terms, and special conditions.
Quotations and commercial proposals shall remain valid strictly for the timeframe explicitly specified therein. Once this period expires without THE CLIENT having accepted the proposal and fulfilled the booking requirements, THE AGENCY reserves the right to modify rates, availability, itineraries, or original terms without obligation to honor the initial offer.
Issuing a quote, commercial proposal, or availability estimate does not in itself constitute a confirmed booking nor does it guarantee service availability until all contracting and payment requirements established by THE AGENCY are met and formal confirmation is issued.
3.2. Booking Confirmation
A booking shall be considered validly confirmed once THE CLIENT accepts the quotation, completes the required deposit or advance payment within the stipulated timeframe, and THE AGENCY verifies service availability and issues formal confirmation through official channels.
Where a pending balance exists, THE CLIENT must remit payment within the timeframe and terms previously communicated by THE AGENCY. Payments processed via credit cards or other payment channels may incur processing fees or surcharges, provided these were disclosed in advance.
Any banking fees, international wire fees, or payment transaction costs shall be covered by THE CLIENT whenever applicable and disclosed prior to payment.
Making a deposit or payment alone does not constitute a confirmed reservation until THE AGENCY verifies proper identification and issues an official confirmation. Bookings remain subject to the specific terms set forth by relevant THIRD-PARTY SUPPLIERS where applicable.
3.3. Passenger Details
THE CLIENT is responsible for providing THE AGENCY with accurate, complete, and up-to-date information for all individuals included in the booking, ensuring that full names and identity details match official government-issued ID cards or passports.
THE CLIENT shall be held liable for any errors, omissions, or inaccuracies attributable to them that directly result in amendment fees, correction charges, reissue penalties, or additional costs levied by suppliers, provided such costs are duly substantiated and directly tied to the provided information.
Nominative tickets, permits, passes, and reservations are personal and non-transferable, unless the specific supplier explicitly permits modifications or name changes. Furthermore, they remain subject to supplier modification, rescheduling, cancellation, and refund policies, which will be disclosed to THE CLIENT whenever applicable.
